1. Introduction & Acceptance

Welcome to OVERPOWERED®. These Terms of Service ("Terms") govern your access to and use of the website overpowerednutrition.com (the "Site") and the purchase of products from OVERPOWERED Nutrition Ltd ("OVERPOWERED®", "we", "us", or "our").

By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or purchase our products.

2. Eligibility

To use our Site and purchase products, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Not be barred from purchasing goods under applicable law

By placing an order, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

You may create an account to access certain features. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised access

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. Products & Disclaimers

IMPORTANT: Our products are food supplements. They are not intended to diagnose, treat, cure, or prevent any disease. They should not be used as a substitute for a varied diet and healthy lifestyle.

  • Always read the label and follow usage instructions
  • Consult a healthcare professional before use if you are pregnant, nursing, taking medication, or have a medical condition
  • Do not exceed the recommended daily intake
  • Keep out of reach of children
  • Store in a cool, dry place away from direct sunlight

Product images are for illustrative purposes. Actual packaging may vary. We strive for accuracy but cannot guarantee that product descriptions, images, or other content on the Site are complete or error-free.

5. Pricing & Payment

All prices are displayed in British Pounds (GBP) and include VAT where applicable. We reserve the right to change prices at any time without notice. However, price changes will not affect orders that have already been confirmed.

Payment is processed securely through our payment providers (Shopify Payments, Stripe, PayPal, Klarna). By providing payment information, you represent that you are authorised to use the payment method.

In the event of a pricing error, we will contact you to inform you of the error and offer you the option to proceed at the correct price or cancel your order.

6. Orders & Fulfilment

When you place an order, you are making an offer to purchase. We may accept or decline your order at our discretion. An order is accepted when we send you an order confirmation email.

We aim to dispatch orders placed before 4:00 PM (GMT/BST) the same working day. Delivery times are estimates and are not guaranteed. We are not liable for delays caused by shipping carriers, customs, or circumstances beyond our control.

Free UK Delivery: Standard delivery within the United Kingdom is free on all orders.

7. Subscriptions

When you subscribe to a product, you authorise us to charge your payment method on a recurring basis until you cancel. Subscriptions can be managed through your account dashboard.

  • Billing: You will be charged automatically at your selected interval (monthly, every 2 months, etc.)
  • Cancellation: Cancel at any time before your next billing date through your account or by contacting support
  • Changes: You may pause, skip, or modify your subscription through your account
  • Price Changes: We will notify you of subscription price changes at least 14 days before they take effect

8. Consumer Rights & Returns

Under the Consumer Rights Act 2015, products must be as described, fit for purpose, and of satisfactory quality. If your product is faulty or not as described, you have a legal right to a remedy.

14-Day Cancellation Right

Under the Consumer Contracts Regulations 2013, you have 14 days from delivery to cancel your order for any reason. To exercise this right, contact us at support@overpowerednutrition.com. You must return the product in its original, unopened condition within 14 days of notifying us of cancellation. Return shipping costs are your responsibility unless the product is faulty.

Empty Pouch Guarantee

In addition to your statutory rights, we offer a voluntary 30-Day Empty Pouch Guarantee. If you're not satisfied with your purchase for any reason, contact support@overpowerednutrition.com within 30 days of delivery for a full refund. This does not affect your statutory rights.

Faulty or Damaged Products

If you receive a faulty or damaged product, please contact us within 48 hours of delivery with photos of the damage. We will arrange a replacement or full refund at no additional cost to you.

9. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, images, product designs, and software, is the property of OVERPOWERED Nutrition Ltd or its licensors and is protected by UK and international copyright, trademark, and other intellectual property laws.

The OVERPOWERED® name, logo, and all related marks are trademarks of OVERPOWERED Nutrition Ltd. You may not use our trademarks without our prior written consent.

10. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorised access to our systems or user accounts
  • Interfere with or disrupt the Site or servers
  • Submit false, fraudulent, or misleading information
  • Use automated systems (bots, scrapers) to access the Site without permission
  • Resell our products commercially without authorisation

11. Limitation of Liability

To the fullest extent permitted by law, OVERPOWERED Nutrition Ltd shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your use or inability to use the Site
  • Actions of third parties, including shipping carriers

Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless OVERPOWERED Nutrition Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms or your use of the Site.

13. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also be entitled to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr (where applicable).

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date". Continued use of the Site after changes constitutes acceptance of the new Terms.
